Attachment 2—Reasons for referral agency response
(Given under section 56(7) of the Planning Act 2016)
The reasons for SARA’s decision are:
The proposed development is for a material change of use to establish multiple dwellings (96 units)
on the subject site.
The proposed development is unlikely to create a safety hazard of state transport infrastructure or
public passenger services by increasing the likelihood or frequency of a fatality or serious injury.
The proposed development is unlikely to compromise the state’s ability to cost-effectively construct,
operate and maintain state transport infrastructure.
SARA assessed the development application against State code 6: Protection of state transport
networks (State code 6) of the SDAP, version 2.6 and determined that without conditions, the
development achieves compliance with the performance outcomes of the state code.
Material used in the assessment of the application:
The development application material and submitted plans
Planning Act 2016
Planning Regulation 2017
The SDAP (version 2.6), as published by SARA
The Development Assessment Rules
SARA DA Mapping system
Human Rights Act 2019.
