                  Condition 20
                  The Development Permit for a material change of use of premises lapses if the first change of use
                  under the approval has not happened by 30 August 2011, unless an application to extend the
                  currency Is approved by Council
            B.    Agree to delete Conditions 3 & 18.

            C.     Refuse to Change/Delete Conditions 16 & 17 for the following reasons:-

                  These conditions include requirements that Council has sought to apply to all developments within
                  the Shire, are considered good practice to achieve sustainability and there is no reason identified
                  why Noosa Springs Resort can not comply with the requirements.

            D.     Issue a Negotiated Decision Notice.

  The developer must comply with the following codes for self-assessable development related to the development
  approved under this Development Permit:-
  Advertising Devices Code.

  The approval is subject to conditions. Noosa Council's conditions are attached. Conditions from the Dept of
  Natural Resources & Mines, as a concurrence agency are also attached.
