Pursuant to sections 78 and 81 of the Planning Act 2016, it is requested that a minor change be made
to development approval RAL19/0018 to amend the Lot 11 building envelope to accommodate a
proposed shed. Payment of the Council application fee will be remitted upon receipt of Council’s
reference number and we enclose the following application documents:
• DA Form 5; and
• Appendices A to E.
The applicant seeks to construct a Class 10a shed with dimensions of 15m by 12m resulting in a floor
area of 180m2 and will have a building height of 6.35m (refer to attached Shed Plans for full details)
outside the approved building envelope for Lot 11. Accordingly a minor change to RAL19/0018 is
required to amend the Lot 11 building envelope to accommodate the proposed shed.
The proposed amendment to the building envelope will locate the shed in an area that is not constrained
by vegetation, slopes or waterways. It is noted that Council overlay mapping is not consistent with on-
site circumstances and isn’t reflective of the findings from the ecological and bushfire reports
undertaken as part of the higher order approval.
CadCon provides boundary, contour & detail and construction surveys, town planning applications, liaison & negotiation with Councils & Government,

The proposed shed location and building envelope amendment will result in non-compliance with AO6.4

prescribed side boundary setback. This matter of non-compliance is detailed below.

with the definitions from the Planning Act 2016. Specifically, the change to the development approval:
i. Would not result in a substantially different development; and
ii. If a development application for the development, including the change, were made when the
change application is made would not cause—
A. the inclusion of prohibited development in the application; or
B. referral to a referral agency, other than to the chief executive, if there were no referral
agencies for the development application; or
C. referral to extra referral agencies, other than to the chief executive; or
D. a referral agency, in assessing the application under section 55(2), to assess the
application against, or have regard to, a matter, other than a matter the referral agency
must have assessed the application against, or had regard to, when the application was
made; or
E. public notification if public notification was not required for the development application
No changes to the development conditions under RAL19/0018 are required to address the proposed
change to the building envelope on Lot 11. Only the approved plans list is to be updated to reflect the
proposed shed plans to enable its construction.
