In accordance with the Planning Act 2016, please find enclosed a ‘properly made’ development application for
Operational Works (excavation or filling for a dam) lodged on land located at 64 Main Street Kin Kin and legally
described as Lot 2 on SP226603. This Development Application has been prepared by ADAMS + SPARKES Town
Planning (hereafter; ‘ADAMS + SPARKES’) for and on behalf of the applicant and landowner, Trillium Apperceived
Pty Ltd. It is noted that this application is lodged in response to a Shaw Cause Notice (Council Ref: COM25/0352),
which was issued on the 7 November 2025.

In support of this Development Application, please find enclosed the following supporting documentation:

      •    Appendix 1 – Earthworks Drawings prepared by BAX Engineering;
      •    Appendix 2 – Engineering Report prepared by BAX Engineering;
      •    Appendix 3 – Show Cause Notice COM25/0352

Payment of the applicable fee will be made upon receiving an invoice from Council.

1.        Subject Site
The subject site is improved by an existing dwelling house, detached garage and various other sheds, outbuildings
and structures within close proximity to the main dwelling and within the fenced paddock areas (see Figure 1).
The site is zoned Rural and has a total lot size of 10.48ha with four (4) frontages, being one (1) to Main Street,
which provides the primary access (approx. 10m), one (1) to Pomona-Kin Kin Rd to a portion of the eastern
boundary (approx. 190m), one (1) to Bowman Street and one (1) to Grady Street. The subject site generally falls
to the north-east away from existing neighbouring residential uses to the north west.

                                                                                                        Page 1 of 3

2.      Proposed Operational Works
This Operational Works Application seeks to formalise the ongoing works to establish the construction of eight
(8) interconnected dams, weirs, swales and grassed platforms, within the northwest portion of the subject site
(see Figure 2). Engineering Drawings prepared by BAX Engineering (Appendix 1) demonstrate the proposed dam
system and earthworks volume. In total the earthworks propose a cut of 11,247m 3 and fill of 8m3 (balance of
11,239m3).

As detailed within The Engineering Report (Appendix 2) prepared by BAX Engineering, the proposed works do
not affect the existing access, or driveway culvert, which will continue to serve as the discharge point. Nor do the
works worsen existing stormwater conditions for upstream or downstream properties.

3.          Application Assessment
Pursuant to Table 5.8.3 of the Noosa Plan 2020, on lots exceeding 5 hectares within the Rural Zone, the
excavation or filling of land for the purpose of constructing a dam is classified as Accepted Development subject
to requirements. However as outlined within the show cause notice, the proposed dam(s) do not satisfy all
requirements to meet Accepted Development, as such a Code Assessable application is required with the
following development codes being identified as Assessment Benchmarks:
        •    Earthworks Code;
        •    Water Quality and Drainage Code;
        •    Landslide Hazard Overlay Code.

In relation to the above Codes, please refer to the Engineering Report prepared by BAX Engineering (Appendix
2), which detail the proposed works and compliance with the scheme provisions. If the proposal does not comply
with the Acceptable Outcome of the relevant code, an alternative solution has been provided, which assesses
the project against the relevant Performance Outcome.

4.          Summary
We trust that this is the information you require to process the application. It is requested that Council
favourably consider the development proposal subject to reasonable and relevant conditions.

Should you have any questions in relation to the advice provided, please contact our office.

Yours faithfully,
ADAMS + SPARKES
TO WN P L ANN ING
