           Dear SirAvladam,

           Re: Application for a Development Approval for Material Change of Use of
                Premises for Extension to Educational Establishment situated at 35 Rules
                Road, Pomona described as Lot 6 RP 848414

           I refer to your application and the representations you have made in respect to the
           Conditions of Approval. On 11 August 2005 Council decided to:

           A.   Approve a change to condition/s 3, 10, 1 1, 12, 13.2, 14, 75, 76, 17 , 18, 20, 22,24.
           B.   Delete Conditions 79,25,27,3I &32.
           C.   Issue a Negotiated Decision Notice.
           D.   Refuse the applicants request for a fulI refund of application fees ($2500); but
                agree to provide a refund to the applicant of 50% of the application fee ($1250) in
                accordance with Council Policy.
           Details of the decision, with the amended conditions, are contained in the attached
           Negotiated Decision Notice.

           You have continuing appeal rights in respect of Council's decision on your application.
           Refer Section 4.1.27. of the Integrated Planning Act.

           Should you wish to obtain more information about Council's decision, the reports and
           staff recommendations and Council Minutes regarding this application are available for
           viewing or purchase at the Level 2 counter of Council offrces. It would assist Council
