That Council note the further report by the Development Planner to the General
Committee Meeting dated 12 September 2022 and the report to the Planning &
Environment Committee dated 6 September 2022 regarding Application No.
MCU22/0062 for a Development Permit for a Material Change of Use for Offices
situated at 2 Emerald Street, Cooroy and:
A. Vary from the recommendations of staff on the basis that:
1. The staff assessment has placed inadequate weight on the need for
development to contribute to the achievement of
a) the District Centres Zone Overall Outcome 2 (g) and (h);
b) the Cooroy Local Plan Performance Outcomes PO3, PO7 and P10.
2. The staff assessment has placed too much weight on the standard and
design of existing nearby development compared to the desired future
character clearly outlined in the plan.
B. Does not agree to the proposed relaxation of height and carparking requirements
due to the failure of the design to meet the outcomes listed above;
C. Advise the applicant that Council would consider relaxation of height
requirements should
1. The second storey parapet be removed and be replaced with a hip roof
design to reflect the traditional character of two storey buildings in the
business district;
2. That the cantilevered awning be replaced with a street awning that
generally reflects the design criteria outlined in Figure 6.4.2.4 - Pedestrian

I, Cr Lorentson inform the meeting that I have a declarable conflict of interest in this matter as
Deborah Reid a submitter to the application, is a personal friend. Although I have a declarable

remain in the meeting room. However, I will respect the decision of the meeting on whether I
can remain and participate in the decision.

shoreline recession due to sea-level rise for 2100 climate change. The
short-term erosion associated with a 500-year average recurrence interval
storm event combined with shoreline recession due to sea-level rise for
2100 climate change to be considered for the design as per the
recommendations of the Royal Haskoing DHV report ‘Report 66 Seaview
Terrace, Sunshine Beach Coastal Hazards Assessment, reference
PA2906-RHD-ZZ-XX-RP-Z-0001 dated 3 June 2022.
18. The footing system and erosion protection system must in accordance with
the works detailed in the Tectonic report “Geotechnical Investigation,
Proposed residence 66 Seaview Terrace, Sunshine Beach”, (Reference
21370-001-Rev 1 dated 28 April 2022) and other supporting documents

19. The design must include the protection of the northern and southern
boundaries of the site to prevent erosion on neighbouring properties
Page 11 of 21
Section 12
GENERAL COMMITTEE MEETING MINUTES 12 SEPTEMBER 2022
exposing the side boundaries of the site to erosion. The minimum extent of
the side boundary protection must be determined by a line drawn at 28°
extending upwards to the west from the base of the rear point of the erosion
as per the recommendations of Tectonic report “Geotechnical
Investigation, Proposed residence 66 Seaview Terrace, Sunshine Beach”,
reference 21370-001-Rev 1 dated 28 April 2022.
20. The design must be accompanied by certification by a Registered

kept to a minimum and must be monitored during the construction of the
development. Driven piles (both sheet piles and pile footings) are not
permitted on the site.
24. Landscaping at the rear of the property and the crest of the existing dune
slope shall be limited to a maximum surcharge of 5kPa unless a site-
specific slope stability analysis is carried out to demonstrate that higher
loads are acceptable.
25. Under no circumstances shall building materials be temporarily stockpiled
in the area of the crest of the existing dune slope or on the slope.
26. Discharge of concentrated stormwater flows onto the dune slope must be
avoided, and under no circumstances will subsurface disposal of water be
permitted using infiltration pits.
27. Stormwater runoff from gutters, down-pipes, driveways, and paved areas
must be collected and directed by pipes into the Council stormwater system

proposed development shall be revegetated as soon as possible to reduce
the potential for erosion.
Earthworks
29. Earthworks required on-site must be carried out in accordance with
Council’s Planning Scheme Policy PSP6 Engineering Design Standards,
so as not to cause the additional ponding of water on any adjoining lands
or concentrate or direct overland flow on to an adjoining property.
30. All earthworks carried out on site must not affect the structural stability of
the adjoining lands and/or buildings and/or structures and/or services.
31. All earthworks and associated retaining structures/batters, both above and

6 LIFEGUARD SERVICES – REQUEST FOR QUOTATION ASSESSMENT (T000075)
In accordance with Chapter 5B of the Local Government Act 2009, Cr Lorentson provided the
following declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Lorentson, inform the meeting that I have a declarable conflict of interest in this matter as
my daughter Giorgia Lorentson and son Ben Lorentson are employed by Surf Life Saving
Queensland (SLSQ) as casual lifeguards. It could be viewed that I have a have a conflict of
interest, however I do not believe a reasonable person could have a perception of bias as my
daughter and son’s employment is of a casual nature and not exclusively bound to SLSQ.
Therefore, there is no benefit or loss specific to my daughter and son, from the outcome of this
application. Therefore, I will choose to remain in the meeting room. However, I will respect the
decision of the meeting on whether I can remain and participate in the decision.
Committee Resolution
Moved: Cr Stewart
Seconded: Cr Finzel
That Council note the declarable conflict of interest by Cr Lorentson and determine that Council
note the declarable conflict of interest by Cr Lorentson and determine that it is in the public
interest that Cr Lorentson participates and votes on this matter because Council believes that
a reasonable person would not have a perception of bias because Cr Lorentson nor her children
stand to receive a personal benefit or loss in relation to this matter, and therefore a reasonable
person would trust that the final decision is made in the public interest.
Carried unanimously.
