3.5. Fisheries Act 1994
The Fisheries Act 1994 deals with the use, conservation and improvement of Queensland’s fisheries resources and
fish habitats. The legislation deals with the impact from coastal development on marine fish habitat, including
protected marine plants and declared fish habitat areas. Development proposals that modify, or have a temporary
or permanent loss of marine fish habitat are assessed by the Department of Agriculture, Fisheries and Forestry.
Under the Act, Fisheries Spatial Data Layer Mapping identifies areas protected as:
• Fish Habitat Management Areas
• Waterways for Waterway Barrier Works; and
• Tidal Waterways.
Where a developed application involves taking or interfering with fisheries resources, approval must be obtained.
Activities which require a Fisheries Development Approval under the Sustainable Planning Act 2009 (SPA) include:
• Building or operational works in a Declared Fish Habitat Area;
• Aquaculture in tidal water, marine and freshwater; and
• Waterway Barrier works in higher order and tidal waterways.
Where development requires approval to take or interfere with a fisheries resource, an application responding to
Module 5: Fisheries Resources of the State Development Assessment Provision (SDAP) is required.
