3.6. State Planning Policy
On 2 December 2013, Queensland Government’s single State Planning Policy (SPP) came into effect, replacing the
previous ten (10) State Planning Policies. Part A of the SPP confirms the hierarchical order of the State planning
instruments, with the SPP placed third below the Sustainable Planning Act 2009 (Qld) (SPA) and State Planning
Regulatory Provisions (SPRPs), but above Regional Plans, Standard Planning Scheme Provisions and Local
Planning Instruments. Part B confirms the application of the SPP to:

    1.   Making or amending of a planning scheme;
    2.   Designation of land for community infrastructure by a Minister;
    3.   Making or amending a regional plan;
    4. Assessment of a development application mentioned in Part E to the extent that the SPP has not been
         identified in the planning scheme as being appropriately integrated in the planning scheme; and
    5. Carrying out self-assessable development mentioned in Part F.

The core of the SPP is contained in Part D, where it identifies sixteen (16) Matters of State Environmental
Significance (MSES) in land use planning and development, arranged into five (5) broad categories. These State
interests will be consequentially integrated into Local Government Planning Schemes access Queensland. Four (4)
State interests are included within the category of Environment and Heritage, which are:

    1.   Biodiversity
    2.   Coastal Environment
    3.   Cultural Heritage
    4.   Water Quality

Importantly, Part E of the SPP provides interim development assessment requirements which ensure that state
interests are considered by local government when assessing development applications where the local
government planning scheme does not yet integrate the State interests in the SPP. Interim development
assessment requirements have been prepared for eight (8) of the sixteen (16) State interests, including
Biodiversity, Coastal Environment and Water Quality. In essence, any development application across a site
containing a State interested identified in Part E will need to demonstrate compliance with the interim
development assessment requirements.

The subject site is mapped as containing MSES – Biodiversity (Wildlife), MSES – Biodiversity (Regulated Vegetation
intersecting a waterway), MSES - Water Quality (Water Supply Buffer Area), MSES - Flood Hazard and Bushfire
Hazard (Figure 7).
