3.7. Town Planning Instruments
In March 2013 the Noosa community voted to de-amalgamate from the Sunshine Coast Region to form the new
Noosa Local Government Area. Sections of the Draft Sunshine Coast Planning Scheme applicable to the new Noosa
Local Government were transferred to the new Noosa Shire Council for its consideration. At the time of writing
this report the former planning scheme, The Noosa Plan 2006, is the effective local government planning scheme
for the prescribed Noosa area.

The application property assessed within this Ecological Assessment Report is located within the jurisdiction of
Noosa Shire Council and subject to the provisions of The Noosa Plan and Cooroy and MacDonald Locality Plan. The
subject site is currently zoned as Rural under The Noosa Plan (Figure 8).

The Cooroy and Lake MacDonald Locality Plan states “Cooroy has potential for growth while maintaining the country
town character. In the balance of the location protection of rural settlement character relies on avoiding the
fragmentation of the countryside and largely limiting developments to existing rural communities”.

The Noosa Plan defines rural settlement as “rural settlement means residential development on a lot greater than
2,000m2, regardless of whether the land is also used for hobby farming. “

3.7.1 Environmental Mapping Overlays
The following ecologically related planning scheme overlays are relevant to the site:

                Biodiversity (Figure 9)
                Natural Resources (Figure 10)
Temporary Local Planning Instrument (Protected Vegetation Overlay)

The Biodiversity Overlay mapping indicates the area surrounding the waterway at the south-eastern extent of the
site is identified as Environmental Protection area and Riparian Buffer Area.

The Natural Resources Overlay mapping indicates that the subject site is within the Water Supply Catchment for
Lake Macdonald and Cedar Pocket dam water supplies.

The Temporary Local Planning Instrument (Protected Vegetation Overlay) applies to the planning scheme area of
The Noosa Plan (prescribed Noosa Area) and states for Category 1, 2 and 3 lots (which includes all freehold lots in
the prescribed Noosa area) all vegetation is protected.

The above overlays will trigger responses to the Biodiversity Overlay Code including Division 2 - General
provisions of the Biodiversity Overlay and Division 3 – Assessment table for the Biodiversity Overlay (Appendix D),
Natural Resources Overlay Code (Appendix E) and the Protected Vegetation Overlay Code (Appendix F).
