5.2 Assessment against the legislation
5.2.1 Council’s legislation
The site is located in the Rural Zone. A Material Change of Use for Dwelling House in Rural zone under
the Noosa Plan is considered an accepted development subject to requirements.
The site is mapped under the Biodiversity, Waterways and Wetlands Overlay Map, with the following
sub-categories: MSES Environmental values, Area of biodiversity significance, and Riparian buffer area
(Error! Reference source not found.). An assessment against the relevant provisions of the Biodiversity,
Waterways and Wetlands Overlay Code is only required if vegetation within the overlay is being removed
or development is proposed within the Riparian Buffer area. The proposed dwelling and associated
bushfire management buffers do not require the removal of vegetation, and they are not to be within the
Riparian Buffer area. The access driveway is also existing and no further clearing is required for this
purpose. However, the proposed waste-water irrigation area will be located within the existing vegetated
area east of the dwelling, and some minor understorey vegetation pruning may be required for its
installation. Therefore, the overlay code has been responded to in this report (Appendix 5). The
proposal complies with all the relevant provisions of this code.
Figure 3: Biodiversity, Waterways and Wetlands Overlay Map
The effluent disposal area is proposed to be located within the existing vegetation area to the east of
the dwelling site (Figure 4). The system will use fixed surface sprinkler irrigation, about 40m from the
eastern edge of the dwelling, 130m from the edge of the mapped Riparian Buffer Area overlay and 330m
to the edge of the Noosa River. The system will be 15m wide x 24m long, covering an area of 360m 2
with 35 sprinkler plumes.
