PROPOSAL
This application seeks a minor change to amend the approved plans for the existing building at 6 – 16 Douglas Street, Sunshine Beach to include proposed changes to the current roof design. The proposed works are required to resolve long standing maintenance issues associated with the original design of the. To facilitate this, the applicant requests to amend condition 1 to capture the updated plans.
The applicant provides a further summary of the proposal:
“As the existing building has aged there has been increasing problems with water ingress which stem directly from elements of the current roof design. In order to resolve these issues the building design consultants, Galbraith Scott Pty Ltd, have recommended amendments to the original design and the key changes, which are summarised below:
Removal of current bullnose roofing, concrete parapets and the installation of glass balustrading along the front and rear elevations of the building to improve roof terrace drainage and waterproofing;
Replacement of existing rusted steel roof pergola structures and durable powder coated aluminium battens;
Replacement of existing rusted/failed roof trusses with durable powder coated aluminium trusses, balcony purlins, cappings and roof sheeting across the roof; and
Replacement of existing roof fixings and painting of roof sheets and capping over entrance roofs.
As will be apparent from the above list, the majority of the proposed works constitute maintenance/repair work and will not alter the maximum height of the existing building or its setback to the property boundaries. However, the applicant has been advised that as the proposed works will have an impact on the appearance of the building a minor change application needs to be submitted to Council for approval.”

Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
The Noosa Plan 2020.
Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development as the works are limited to repairs and restoration and does not substantially alter the built form and scale of the development;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.
Statutory Instruments – Planning Scheme
The following codes from the Noosa Plan 2020 are applicable to this development:
High Density Residential Zone Code;
Coastal Communities Local Plan Code;
Dual Occupancy and Multiple Dwelling Code; and
Works Codes.
The proposed changes are limited to roof form. The proposed works would not alter building height and setbacks and would remain consistent in terms of bulk and scale, and presentation to that of the original approval. This is further discussed below.
Condition 1
Applicant’s Request
The applicant requests that the condition be amended to capture the updated plan set.
Assessment of Request
The proposed works do not alter the approved maximum height of the building or it’s setbacks to the property boundaries. The overall appearance and presentation of the development remains consistent with the original built form. It is also noted that the proposed works are largely required to restore parts of the development that is subject to dilapidation. A condition will be imposed in regard to overlooking and protection of privacy.
The assessment of the proposed works against the current Noosa Plan 2020 also confirms that the proposed changes to the building remain consistent with the relevant assessment benchmarks.
The proposed roof form does not raise concern and the request is supported.
