I refer to your application and representations you made in respect of Council’s Decision Notice. On 7 February 2023, Council decided your representations.

The applicant’s representation does not specifically mention any of the conditions listed in Council’s Decision Notice. However, the contents of the representations suggest that the applicant does not wish to construct a driveway crossover as called for in these Conditions.
In relation to the representations, Council decided to refuse the changes for the following reasons:
The existing Myles Street access is unformed and not suitable for the proposed “Ute and trailer” use described by the applicant in its current form.
The existing Myles Street access does not comply with Council’s standards.
Allowing vehicles to traverse the unformed access is likely to cause damage to Council’s road reserve, creating additional maintenance requirements for Council.
The potential creation of traffic hazards (for pedestrians and vehicles) due to a potential increase in traffic flow about the secondary access as Council cannot enforce how frequently the access is utilised as described by the applicant.

You are entitled to appeal against this decision as previously outlined in the Decision Notice.  A copy of the relevant appeal provisions from the Planning Act 2016 was included in the Decision Notice.
Please note that in accordance with the Planning Act 2016, the applicant’s appeal period is no longer suspended once you have received this notice.
