PURPOSE

The purpose of this report is to review the current planning and development delegations that
have transferred from Sunshine Coast Council under the provisions of the Local Government
(De-amalgamation Implementation) Regulation 2013 and De-amalgamation Transfer
Methodology.

EXECUTIVE SUMMARY

The current delegations for planning and development transferred to Noosa Council in
accordance with the de-amalgamation regulations and methodology. These include:

2009- 20 (v3) - Building Services
2009- 35 (v3) - Sustainable Planning
2009- 22 (v2) - Integrated Planning
2011- 42 (v1) - Planning Scheme - Development Control Plan 1 (Kawana Waters)
2012-49 (v1) - Sustainable Planning Act - Master Plans

This report reviews the current delegations that transferred to ensure they address current
legislation and are appropriate for the Noosa area. The report concludes that some minor
changes are required to address legislative changes and identifies that some delegations are not
applicable to the Noosa area and should be rescinded. Amendments to the Sustainable
Planning Act 2009 delegations are also recommended in respect to those development
applications that are required to be reported to a Council meeting.

RECOMMENDATION

That Council note the report by Coordinator, Development Assessment to the Planning &
Organisation Committee dated 25 February 2014 and
A.   Delegate to the Chief Executive Officer pursuant to section 257 of the Local Government
     Act 2009 the exercise of powers as contained in Attachment 1;
B.   Delegate to the Chief Executive Officer pursuant to section 257 of the Local Government
     Act 2009 the exercise of powers as contained in Attachments 2 & 3; subject to the following
     limitations in deciding development applications under the Integrated Planning Act 1997
     and Sustainable Planning Act 2009:
