PURPOSE

To update Council as to the previous application of National Competition Policy (NCP) reforms to
affected Council business activities for the 2013/2014 financial year by Sunshine Coast Regional
Council (SCRC), and recommend the continued application to identified Noosa Council business
activities for 2013/14.

EXECUTIVE SUMMARY

The Local Government Act 2009 requires Council to decide each financial year whether to apply
competition reform to its identified Council business activities. Certain activities of Council are
required to be identified as business activities if they trade in goods and services that could
potentially be delivered by a private sector firm for the purposes of earning profits in the absence
of Council’s involvement.

Expenditure thresholds are published each financial year by the Queensland Government and
Councils are required to determine if an activity is a significant business activity based on the
definition under the Local Government Regulation 2012, or a prescribed or smaller business
activity when implementing the Competitive Code of Conduct.

Two activities have been identified that meet the criteria and relevant threshold level for
identification as business activities. The activities identified and reform levels to apply based on
the estimated budgeted expenditure in 2013/14 are:

 Business Activity Reform Level
 Waste Management Significant
Caravan Parks Code of Competitive Conduct

RECOMMENDATION

That Council note the report by the Interim Director, Organisational Services to the Planning &
Organisation Committee dated 25 February 2014 and:

A. Apply the Full Cost Pricing reform option to the Waste Management business activity for
the remainder of the 2013/14 financial year in accordance with section 44(1)(b) of the Local
     Government Act 2009; and

B. Apply the Code of Competitive Conduct to the Caravan Parks business activity for the
remainder of the 2013/14 financial year in accordance with section 47 of the Local
     Government Act 2009.
