PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 FEBRUARY 2014
REPORT
The current delegation instruments that are primarily applicable to planning and development
matters that transferred from the Sunshine Coast Council include:
2009- 20 (v3) - Building Services
2009- 35 (v3) - Sustainable Planning
2009- 22 (v2) - Integrated Planning
2011- 42 (v1) - Planning Scheme - Development Control Plan 1 (Kawana Waters)
2012-49 (v1) - Sustainable Planning Act - Master Plans
Review of these delegations finds that 2 of the delegations, including delegations in respect to
Kawana Waters and Master Plans are not relevant to the Noosa area, with Kawana Waters
located outside the Noosa Shire, and the master planning process in the Sustainable Planning
Act 2009 now removed from the Act.
The delegations relating to Building matters require some minor amendment to reflect legislative
changes to now address the Residential Services (Accreditation) Act 2002. It is also be
appropriate for council to review the delegation instrument for the Sustainable Planning Act 2009
in respect to those development applications that are not delegated to the Chief Executive Officer
and must be decided at an Ordinary Meeting of Council.
Currently, the delegations that transferred from the Sunshine Coast Council require the following
applications to be decided at an Ordinary Meeting of Noosa Council:
(a) an application where the estimated construction value of the proposed development
exceeds $50 million (excluding land content);
(b) an application for the approval of a master plan for a master planned area;
(c) an application for a preliminary approval mentioned in section 242 (Preliminary approval
may affect a local planning instrument) of the Act that states the way in which the
application seeks the approval to vary the effect of any applicable local planning instrument
for the land;
(d) the approval for a proposed development where there is substantial non-compliance with a
stated policy of the council or a high order provision of the planning scheme being a
desired environmental outcome, strategic outcome, or an overall outcome of a code;
(e) an application for a proposed development where more than 20 submissions have been
received during the notification stage objecting to the proposed development.
(f) Development applications where a councillor of officer has a material personal interest in
the development application.
It has also been the practice of Sunshine Coast Council to refer all reports on impact assessable
applications to councillors for 3 business days to provide an opportunity for councillors to request
a matter to go to a council meeting for a decision.
In reviewing the current delegations, a number of examples were sought from other council’s in
Queensland, including:
Redland City Council
Cairns City Council
Moreton Bay Regional Council
Ispwich City Council
Gympie Regional Council
