PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 FEBRUARY 2014
Operational, building, plumbing or drainage works
Minor development matters including applications which are unlikely to cause a substantial
impact on the amenity of nearby land and involve building work not associated with a
material change of use (eg. Reduced front setbacks) and a minor amendment to a current
development approval.
Operational, plumbing or drainage works and minor development matters may be decided by
delegation.
Gympie Regional Council
The delegations for Gympie Regional Council require the following matters to be decided at a
Council meeting:
Refusal of any development application
All development applications where submissions have been received objecting to the
proposed development. This may be impact or code assessable applications.
Councillors also have the ability to request an application to be reported to a Council meeting.
Conclusion
There are some similarities in the delegation instruments of the council’s reviewed, with a
number of the council’s requiring applications of significant community interest, and shire wide
significance to be decided at a council meeting, with some differences noted for Ipswich and
Gympie. Some council delegations also provided for the ability for councillors to request a matter
to go before a council meeting. The delegations do not significantly vary from the Sunshine
Coast Council delegations which transferred, with the Sunshine Coast Council delegations
seeking to define those applications that are of shire or regional significance, based on a
monetary value and number of submissions received.
For Noosa Council some changes are recommended to the existing delegations to remove the
limitations relating to master planned areas as the master planning process is no longer part of
the Sustainable Planning Act 2009. It is also recommended that the monetary value and number
of submissions received be replaced with all applications of significant community interest to be
decided by a council meeting. Applications of significant community interest may include
development proposals for highly prominent or environmentally sensitive sites such as Hastings
Street, Gympie Terrace or proposals on the Noosa North Shore; new developments in the
business centres; prescribed tidal works for commercial operations on the Noosa River; heritage
sites; proposals of significant construction value ($20 million) and applications attracting 20
opposing submissions.
A new limitation to the delegations is also recommended in respect to refusal of development
applications given the appeal cost implications and consequences for the applicant. However, it
would be appropriate that some exclusions apply for statutory time constraints, or practical
reasons to this delegation limitation.
FINANCE & RISK
No Financial Implications. There is a minor a risk if the current delegations are not amended as
they do not address some legislative changes in respect to the Residential Services
(Accreditation) Act 2002 and the Local Government Act 2009.
