SUNSHINE COAST 23 August 2017 Job Ref: M2652 Noosa Council By Email: [email protected] Att: Patrick Murphy – Coordinator Planning Re: Response to Information Request – Development Application for Development Permit to Reconfigure a Lot – Layered CTS (26 Balance Lots) & Access Easement (Council Ref. REC 17/0022) Dear Patrick, We refer to Council’s Information Request, dated 8 August 2017 , regarding the abovementioned application. In accordance with s278 of the Sustainable Planning Act 2009, and on behalf of our client Altum Constructions Pty Ltd, we hereby provide all of the information requested as outlined below. 1.0 GENERAL COMMENT In order to respond to the issues raised by Council, and following discussions at our meeting of 9 August 2017, we thought it prudent to offer Council additional information and further description as to the intent and structure of the proposed reconfiguration of a lot. The proposed reconfiguration of a lot is intended to facilitate the delivery of a layered community title scheme (CTS) directly correlating with the intended staging of the multiple dwellings to be constructed over the subject land. The multiple dwellings to be delivered over the subject land are as reflected by Development Approvals 132005.1133.5 and MCU15/0109, for which amended approvals (by way of a minor change application or negotiated decision notice respectively) are understood to be imminent. The general structure of the CTS is as follows:- 1. Principal CTS – to be established over the whole of the subject land, with all areas comprising driveway access and communal recreation areas to be managed as common property within this scheme. As requested by Council at our meeting of 9 August, the extent of principal common property will include permanent stormwater detention basins and the portion of the site located between the circulation driveway and the eastern and southern property boundaries. A further access easement will also be provided as per the conditions of 132005.1133.5, which extends across Lot 6 (i.e. Precinct E2) to the cul- de-sac end of Resort Drive. 2. Subsidiary CTS’s – nine (9) subsidiary CTS’s are proposed generally aligning with the anticipated sub- staging of the multiple dwelling approvals. Each subsidiary CTS will be created following sealing and registration of up to 26 building format plans (BFPs) across the site.
