Division 1 Reconfiguring a lot

regional landscape and rural pi ction area
(1) Reconfiguring a lot is prohibited development to the extent
the lot is in the SEQ regional landscape and rural production
area, if the reconfiguration—
(a) isa subdivision; and
(b) is assessable development under section 21.
(2) However, subsection (1) does not apply if
(a) _ the reconfiguration is an exempt subdivision; or
(b) the lot is in an SEQ mural subdivision precinct and the
reconfiguration is consistent with the purpose statement,

and minimum lot size, for the zone applying to the lot
under a local planning instrument; or
(c) each lot created by the reconfiguration is at least 100ha;
or
(d) the lot is in an area identified in a gazette notice by the
Minister as having a rural residential purpose and an
application for the reconfiguration was properly made
under the old Act or the repealed IPA on or before 6
December 2010.
(3) In this section
SEQ rural subdivision precinct means an area in the SEQ
region identified in a gazette notice by the Minister as a rural
subdivision precinct.
