Figure 1 – Locality Plan
Nowhere else is this situation allowed in the Medium density residential zone, as mixed-use developments are usually
reserved for centre/ commercial zones. The relevant provisions also mandate that the commercial aspect occurs at grade
and for carparking to be provided at the rear. Hence, the residential component is required to be established above
ground or on the first floor. That is, in an apartment format instead of a traditional 2 storey townhouse format with
bathroom at ground level.
In the event we were providing a standalone residential (multiple dwelling) development, as is usually anticipated by the
zone, the provision of step free access, wide door openings and bathroom at grade would be readily achievable to satisfy
AO9 of the Dual Occupancy and Multiple Dwelling Code.
In this instance, however, the planning scheme expresses a local planning intent for an apartment style typology for the
site, by virtue of its support for mixed use format development outcomes for the site and the other 6 small sites
identified in Peregian Beach. As a consequence, it promotes mixed use development above the desire for development
which is accessible by people of varied mobility, who can be catered for in other Medium Density Residential zoned sites,
located in close proximity to centre precincts.
