           ()   Areference to an item is a reference to an item in Schedule 1.
           (m) Where this Agreement refers to 2 particular officer or job title within
                the Council (for example the Manager of Land Usa), and the title or
                duties of that officer change from the date hereof, the reference to the
                particular officer will be deemed to be a reference to the officer who
                holds the relevant duties from time to time,

           “Act” means the Integrated Planning Act 1997 and includes the Local
           Govemment (Planning and Environment) Act 1990         and the Local
           Govemment (Planning & Environment) Regulation 1991 to the extent that
           they are relevant to the Development Application by operation of the
           Integrated Planning Act 1997 or the Acts Interpretation Act 1954.
           “Agroement” means this Infrastructure Agreement.
           “Appeal” means an appeal to the Court under the Act.
           “Approved Plans " means all of the plans annexed to this Agreement,

           (a)  Architectural Drawings propared by ETS group {Annexure 1) and
                entitled—
                (i)  AO1 RevC Site Plan deted April 2007;
                (i)  AO2 Rev C Setout Plan (Proposed Main Building) dated April
                     2007;
    .           (iii) AO3 Rev C Main Building Setout Plan — Ground Floor dated
                 -   April 2007; '
                (iv) AO4 Rev C Main Building Setout Plan — Upper Floor Plan dated
                     April 2007;
                (v)  Utility Building Plan dated 15 February 2007; and
                (vi) Preliminary Floor Plan (Bedroom Wing) submitted to the Council
                     on 24 July 2007.
           (0)  Survey Plans: Survey Plans showing 0.85m Contour Plan No.
                HO60602B prepared by Hass Survey dated 2 October 2006
                (Annexure 2).
           “Approved Reports” means all of the reports annexed to this Agreement;   .
           being: -
           (a)  Effluent Disposal System: Site and Soil Evaluation Report for
