I refer to your query below seeking further clarification exempted development requirement under the Planning Act 2017 in relation to vegetation clearing within a Koala Priority Area and Core Koala Habitat Area under the Koala Conservation Strategy Mapping. 

 

The following supporting documents provide extensive detail about the clearing exemptions required for essential management:

*	Appendix B – Ecological Assessment Report;
*	Appendix C – Bushfire Hazard Assessment;

 

Section 4 of the Bushfire Hazard Assessment report details the necessary setbacks Asset Protection Zone (APZ) required for bushfire purposes which is generally a 26m setback from the hazardous vegetation. 

 

Section 5 and 7 of the Ecological Assessment Report provides details about the vegetation clearing required for essential management for bushfire purposes (under schedule 24 of the planning regulation(n)(vii)). It has been determined that a total extent of 2,900m2 is necessary for the Asset Protection Zone (26m setback around perimeter of building). The clearing required is illustrated in figure 1 which is detailed below.

The application form seeks approval for a new dwelling – it is Council’s understanding that an existing dwelling is already located on site. Can you please clarify if it was intended that the application is intended to be for a secondary dwelling.

 

Furthermore, we are unable to accept this application as it does not sufficiently demonstrate how it meets the exempted development requirements of the Planning Act.  You need to demonstrate on an annotated (to scale) map each structure and the extent of clearing for each of the exempted development provisions which will indicate if you meet the exemptions in order for Council to accept the application.  A bushfire management plan is required to be prepared to inform the (n) (vii) exemption and submitted with the map in order for us to accept the application.

 

You need to demonstrate which of the below exemptions that you are applying for, eg:
