PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 AUGUST 2018
5. CONCLUSION & REASONS FOR DECISION
The application proposes to develop an additional 6 residential aged care buildings for the
purpose of accommodating an additional 48 residents at an existing aged care facility. The
proposal also includes an entry/administration building. It is recognised that the proposal
provides for a use for which there is a significant need. The proposed development would result
in the removal of approximately 7500m2 of vegetation, including wetland vegetation, which is
protected by the Biodiversity Overlay. Furthermore, development would occur within an area that
is subject to flooding. Habitat for the Swamp Crayfish has been identified on site. The Swamp
Crayfish is listed as an Endangered Species under the Nature Conservation Act 1992 and
internationally under the IUCN Red List of Threatened Species.
Due to the impact of the proposed development on protected vegetation and the endangered
Swamp Crayfish it is recommended that a Preliminary Approval be issued. The Preliminary
Approval requires a modified building footprint which protects the ecological values of the site
and removes development from within the Q100 flood line. The modified building footprint will
protect the wetland vegetation and Swamp Crayfish habitat.
A Preliminary Approval would require the applicant to submit a further development application
which demonstrates compliance with the conditions of the Preliminary Approval. Alternatively, the
applicant may lodge Representations to the Preliminary Approval seeking that a Development
Permit be issued.
