Approximately 1,830m2 of mapped of concern RE 12.9-10.1 is required to be cleared to accommodate the
proposed dwelling and associated Asset Protection Zone (above the 10m exempt clearing around the
allotment boundary). Clearing of native vegetation on freehold land is exempt clearing works where it is
for residential clearing as per Schedule 21, Part 2, Section 2(b) of the Planning Regulation 2017. In this
regard, referral to the State Assessment and Referral Agency (SARA) is not required for assessment against
State Code 16 for clearing native vegetation.
7.4 NATURE CONSERVATION ACT
7.4.1 FLORA
The Protected Plants Flora Survey Trigger Map identifies that the vegetated areas within the site are
mapped as a high risk area under the Nature Conservation (Plants) Regulation 2020. Approximately
2,900m2 of vegetation mapped as a high risk area is proposed to be cleared. The flora survey carried out
in August 2021 was undertaken in general accordance with the flora survey guidelines and no
conservation significant flora species were identified during the site survey. The applicant is required
under the Nature Conservation Act 1992 to undertake a formal flora survey and submit a Flora Survey
Report and Exempt Clearing Notification to DES prior to any vegetation removal within the site. Note that
the survey results are only valid for twelve months after the date the survey was undertaken and clearing
must be undertaken within this time frame to avoid the need for an additional flora survey.
7.4.2 FAUNA
A fauna spotter/catcher is recommended to be present during vegetation clearing to satisfy the duty of
care requirements under the Nature Conservation (Animals) Regulation 2020. Where active breeding
habitat for least concern native fauna is observed, the applicant will be required to comply with the
existing DES Species Management Program – low risk of impacts. Where active breeding habitat for
Conservation Significant fauna species is to be impacted, the applicant will be required to prepare and
submit a DES compliant Species Management Program – High risk of impacts for approval prior to
clearing/impact commencing.
7.5 COMMONWEALTH GOVERNMENT
No Matters of National Environmental Significance (MNES) were identified during the field investigation
undertaken within the site. Whilst a fauna survey has not been completed the results of the habitat
assessment infers that the threatened fauna species identified in the Protected Matters Search Report
have a low potential to occur within the site due to the limited amount of suitable habitat and/or a lack
of existing records in the locality. Furthermore, the extent of habitat disturbance is unlikely to result in a
significant impact to any populations of the listed EPBC fauna species hence a referral to the
Commonwealth government under the EPBC Act is deemed unnecessary.
