Environment Committee Meeting 11 March 2025 regarding applications that have been decided by
delegated authority for January 2025 as per Attachment 1 to the Report.
REPORT
The Local Government Act 2009 allows, by resolution, a local government to delegate its powers to
the Mayor, CEO, a standing Committee or a joint standing committee and the CEO to delegate those
powers to another employee of Council.
Under the current delegations for the Planning Act 2016 the ability to manage, assess and decide a
range of development applications are delegated to officers with the exception of the following which
are reported to Council for a decision.

effect of the Planning Scheme;
b. An application which is for an inconsistent use as defined in the Planning Scheme;
c. An application for a proposed development where more than 30 submissions have been received
during the notification part objecting to the proposed development;
d. An extension of an approval that was made under a superseded Planning Scheme (i.e. pre-Noosa
Plan 2020) and/or where there is a resolution of Council to amend the Planning Scheme in a way
that is relevant to the approval;
e. An impact assessable application involving the clearing of vegetation which is mapped as being

containing an endangered regional ecosystem, except in circumstances where the clearing is
exempt clearing;
f. The removal or demolition of a structure or place identified within the Planning Scheme's Heritage
and Character Overlay Map;
It should be noted though that due to the strict time frames of the Planning Act 2016, the officers
under the current delegations have the ability to decide an application where the application has the
potential for 'deemed approval'. In accordance with the current delegations, a wide range of
applications reported to Council for a decision.
