Hollett Road Ecological Assessment
Minor Change Application - 191 Hollett Road, Noosaville
3.2 State Compliance Measures
With respect to the State Planning Policy and Development Assessment Mapping, Table 3-2 outlines how the revised plans will address the environmental legislative
requirements pertaining to the site.
Table 3-2 Compliance measures in accordance with the SPP and DA mapping.
Element Compliance Statement
Coastal management district The entire site is entirely within the Coastal management district. With reference to Matters of State Environmental Significance the following is noted
The proposal avoids all areas of remnant regional ecosystems under the Vegetation Management Act 1999.
The proposal avoids wetlands in a wetland protection area or wetlands of high ecological significance shown on the Map of referable wetlands under the Environmental
Protection Regulation 2008.
The proposal avoids wetlands and watercourses in high ecological value waters as defined in schedule 2 of the Environmental Protection (Water) Policy 2009.
The proposal avoids designated precincts in strategic environmental areas under the Regional Planning Interests Regulation 2014.
The proposal avoids impacts on threatened wildlife under the Nature Conservation Act 1992 and special least concern animals under the Nature Conservation (Wildlife)
Regulation 2006.
The proposal avoids protected areas under the Nature Conservation Act 1992 excluding coordinated conservation areas.
The proposal avoids highly protected zones of state marine parks under the Marine Parks Act 2004.
The proposal avoids declared fish habitat areas under the Fisheries Act 1994.
The proposal avoids waterways that provide for fish passage under the Fisheries Act 1994 if the construction, installation or modification of waterway barrier works carried
will limit the passage of fish along the waterway.
The proposal avoids marine plants under the Fisheries Act 1994.
The proposal avoids legally secured offset areas.
Regulated vegetation The proposal avoids all areas of remnant regional ecosystems under the Vegetation Management Act 1999.
Fish habitat and waterways The proposal avoids fish habitat and waterways mapped for waterway barrier works
Protected Plants A flora survey in accordance with the Flora Survey Guidelines - Protected Plants Nature Conservation Act 1992 will be required for the Site at a later date.
Koala Habitat The Environmental Protection Agency (EPA) gave a concurrence agency response which contained advice which deals with koala matters as part of the approval.
The development footprint has been reduced and building location envelopes have been introduced in order to increase vegetation protection. The proposed development
layout retains all areas of remnant in addition to tracts of regrowth vegetation across ~82% of the site that is to be dedicated as a park or under covenant. The remaining
~12% to be developed supports either grasses or regrowth vegetation. The revised design remains consistent with advice provided by the Environmental Protection Agency as
part of the original approval and result in greater alignment with the outcomes sought under Section 7 of schedule 11 in the Planning Regulation 2017 (assessment
benchmarks for development in koala habitat areas).
