SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 DECEMBER 2017

     e   Generally, operates 3 days per week or less;
         This requirement could be included as a reasonable conditioning of any permit.

     e   Low community impact;
         OLGR requirements are such that no outside music or amplification is allowed. Staff monitor
         and measure sound levels on a hourly basis at the nearest receptor and record within a log
         book the readings.

     e May not operate ina Commercial High Use Permit location; and
         The area has not been identified as a High Use location.

     e Applications may be considered at any time.

     3. DNRM consider the opportunity to undertake a land swap for Garden land directly adjoining
         the Northern side of the building within Freehold Title for the requested portion within the
         adjacent park land. There is sufficient land for a like for like transfer, the land is still meeting
         the restaurants Landscaped Open Space requirements and this is a plausible option that has
         occurred in many other localities within Queensland;

     4. The portion of land is exercised from the State Land and through and expression of interest
         process an opportunity is available for purchase of the land; and

     5. DNRM create a lease over the portion of land and directly lease the portion to the operators
         of the restaurant.

  Conclusion

   The land is well located for the holding of wedding event which is of significant economic benefit to
   the general community. It is a parcel of land that is not used by the community due to its small size,
   problematic access to the canal and separated from the major areas of the Noosaville Foreshore.

   Whilst it may be considered an incorrect use of State Land for which Council is the trustee, upon
   closer inspection of relevant legislation, frameworks are available to manage a reasonable outcome
   within a small portion of adjacent land to an existing commercial operation.

   We respectfully request that diligent and due consideration is given to our submission and
   appropriate ongoing discussions occur as part of the future engagement on the Noosaville Foreshore
   Management Plan.

                                                                                          Page 17 of 79
