1.2. SITE DESCRIPTION

The subject property comprises 3 Lots located at the south-western intersection of
Cooroy Belli Creek Road and Old Ceylon Road at Ridgewood. The property contains
a total area of 81.31ha.

The property has been operating as a family-run dairy and cropping farm for several
decades.

Two dwelling houses and numerous sheds and outbuildings stand adjacent to the
Cooroy Belli Creek Road frontage, with structures standing over the existing
boundaries.

The properties are generally undulating to steep and have been cleared of treed
vegetation in the past, with vegetation remaining along the watercourses.

Power and telephone services are connected and available to the properties from the
Cooroy Belli Creek Road frontage.

Both Cooroy Belli Creek Road and Old Ceylon Road are good quality bitumen roads.
Two separate driveways provide ingress/egress to Cooroy Belli Creek Road for each
dwelling.

The adjacent properties to the property range between 2ha and 22ha.

2. PROPOSAL

It is intended to realign the common boundaries of the Lots to eliminate the
encroachments as shown on the Plan of Proposed Reconfiguration (Ref: 19-4895AB
contained in Appendix A).

The proposed new common boundaries are located to reflect the terrain and
significant vegetation and utilizes the existing property boundaries. The new lot
layout reflects the use of the property and will improve the management of the land.

The proposed new Lots containing the dwelling house contain 2.158ha and 5.81ha
each and the balance Lot contains 7334ha

The proposed new Lots contain the relevant structures, driveways, services and
effluent disposal areas of the Lots.

The existing southern driveway access onto Cooroy Belli Creek Road is intended for
use as a driveway of proposed Lots 49 and 429.

The strip of land between Lots 49 and 158 is proposed as service corridor;
particularly for electricity, from the existing services on Cooroy Belli Creek Road
frontage to the house site area of Lot 429.

The realignment has no impact upon the adjoining properties or upon the existing
services. The new Lot areas will be within the range of the areas of adjacent
properties.

3. STATUTORY ASSESSMENT — STATE GOVERNMENT
3.1 State Planning Regulatory Provisions

The site is included within the SEQ Regional Plan State Planning Regulatory
Provisions — Land Use Category of Regional Landscape and Rural Production; no
additional Lots are created therefore no further assessment is required.

3.2 Referral and State Development Assessment Provisions

A portion of the subject land is mapped as being affected by Category A or B
vegetation; therefore, it is considered that the application will require referral to SARA
as a concurrence agency.

The proposed new boundaries have been located to be outside of the areas mapped
with Category A or B vegetation.

A portion of the subject land is mapped as having Core Koala Habitat Area;
therefore, it is considered that the application will require referral to SARA as a
concurrence agency.

Page 4

The new boundaries are generally located outside of the Core Koala Habitat Areas or
where the linkages are of a minimal width.

3.3 State Planning Policies

The site is not mapped as being affected by any of the State Planning Policy’s State
interest

4. NOOSA PLAN 2020
The subject lands are located in the Rural Zone.
The subject lands are affected by the following Overlays of the Planning Scheme:

e Agricultural Land: Agricultural Land Conservation Area

° Biodiversity: Area of Biodiversity Significance
Riparian Buffer Area
Waterway

Bushfire Hazard: High Potential Bushfire Intensity
Moderate Potential Bushfire Intensity
Potential Impact Buffer

Landslide Hazard: — High Hazard Area
Moderate Hazard Area

The above overlays do not affect the level of assessment of the application.

The proposal has been assessed against the relevant codes including: The Lot
Reconfiguration Code, the Rural Zone Code, the relevant overlay codes and the
relevant development codes. The aspect of the codes that does not comply with the
Acceptable Solutions is discussed below.

4.1 Reconfiguring a Lot Code
Performance Outcome PO5

The proposed Lots do not comply with the preferred minimum lot size of 100ha as
specified in Table 9.5.1.4. of the code.

Notwithstanding the above it is considered that the proposal can satisfy the relevant
requirement of Performance Outcome POS for the following reasons:

e The proposed lots are appropriate with the intended use and the character of
the local area.

e The proposed Lots eliminate the encroachment of houses, sheds, services
and driveways.

Page 5

e The proposed lot areas comply with the minimum prescribed area prescribed
in the relevant Planning Scheme at the time they were originally created.

e The new boundaries have been located to avoid traversing the areas with
significant vegetation.

* The size and the shape of the proposed Lots are sufficient to accommodate a
dwelling houses and effluent areas and are consistent with the character of
the local area.

e The shape of the Lots reflects the existing landform and extent of vegetation.

e There is no impact upon the provision of services or access to the Lots.

4.2 Overlay Codes

Specific Outcomes and Probable Solutions of Biodiversity, Waterways and
Wetlands Overlay Code

The new Lot boundaries created by the proposal transect areas cleared of treed
vegetation and reduced areas mapped as Riparian Buffer on the Biodiversity Overlap
Map; therefore the new lot layout will have lessor impact upon the areas mapped in
the Biodiversity Overlay Map.

This assists with the conservation of the sensitive areas and avoids any
fragmentation of the environmental values.

Specific Outcomes and Probable Solutions of Bushfire Hazard Overlay Code

The proposed Lots contain areas designated as Bushfire Hazard. The development
does not increase risk to people or increase the severity of any risks.

Specific Outcomes and Probable Solutions of Landslide Hazard Overlay Code

The proposed Lots contain areas designated as Slide Hazard. The development
does not increase risk to people or increase the severity of any risks.

5. CONCLUSIONS

The planning assessment has been prepared to accompany a code assessable
application for a Development Permit for Reconfiguration of Lot 429 on MCH481, Lot
49 on MCH1168 and Lot 158 on MCH1321 to realign the common boundaries.

Page 6

The assessment concludes that the proposal complies with, or with the imposition of
relevant conditions, the relevant provisions of the applicable codes in the Noosa Plan
2020; therefore it is recommended that the application should be approved subject to
reasonable and relevant conditions of approval.

| look forward to Council processing the application. Do not hesitate to contact this
office if you have any queries.

Yours faithfully
