DELEGATE DESCRIPTION OF POWER DELEGATED LEGISLATION ADOPTED BY CONDITIONS TO WHICH
COUNCIL THE DELEGATION IS
SUBJECT
Chief Power, where Council has passed a resolution under subsection Section 71(2) Plumbing
Executive (1), to:- and Drainage
Officer (a) publish each declaration on its website; Regulation 2019
(b) give the chief executive a copy of the declaration;
(c) ensure the declaration may be inspected, free of charge,
at the local government’s public office; and
(d) ensure each remote area declaration includes a map
identifying the remote area.
Chief Power, in the circumstances identified in subsection (1), to Section 73(2)
Executive decide to:- Plumbing and
Officer (a) accept the remote area compliance notice; or Drainage Regulation
2019
(b) otherwise, refuse to accept the notice.
Chief Power, in the circumstances identified in subsection (1) and Section 73(3)
Executive where Council has made a decision under subsection (2), to give Plumbing and
Officer the responsible person a decision notice. Drainage Regulation
2019
Chief Power, in the circumstances identified in subsection (1) and Section 73(4)
Executive where Council has refused to accept the remote area Plumbing and
Officer compliance notice, to ensure the decision notice includes, or is Drainage Regulation
accompanied by, an information notice. 2019
