Code Objective Developer’s Assessment Objectors’ Assessment road network failed to provide an objective evidence or argument to show otherwise. BUSINESS USES CODE 020 Development is designed and sited to avoid noise emissions that unreasonably diminish the amenity of the area or surrounding uses. 020 Complies The proposed development is suitably distanced and buffered through landscaping from sensitive land uses. Further, as the site is located ona busy road and roundabout, it is considered that there will be no worsening effects in terms of noise. Does not Comply The proposed Development is not suitably distanced or buffered from the adjacent School which is a sensitive land use. Statements to the effect that “it is considered” that there will be no worsening effects in terms of noise are conjecture without supporting evidence such as detailed studies showing existing background noise levels and projected additional noise generation, particularly given the proposed Development’s proximity to the noise sensitive study environment of the School 027 Buildings and structures are designed to minimise opportunities for vandalism. $27.1 Complies The proposed development will incorporates a building design and layout which will provide for non-graffiti friendly development, structures and layout through design within an absence of natural ladders, minimal unbroken vertical surface areas, CCTV surveillance, a small retail and fast food component (not conducive to loitering), a layout which will promote passive surveillance over the site, be well illuminated and comprise minimal opportunities for concealment. Does not Comply All such facilities are conducive to loitering and provide opportunities for concealment which poses an unacceptable danger to the students going to and from the school particularly in early mornings or evenings before or after extracurricular school activities. Furthermore the close proximity of such a facility poses and unacceptable risk opening the way for graffiti, vandalism, theft, damage to the security of the School premises and harm to its students.
