PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 19 APRIL 2016
At around 100m2, the retail shop component will not significantly detract from the site’s overall
industrial function, nor the Industry zone more broadly, and it will not have a significant impact on
Noosa’s existing retail centres.
Specific Outcome O1 of the code concerns the compatibility of new uses with existing
development, it states:
O1 Uses are located, designed and operated to avoid significant adverse changes to the light, air
quality, noise, accessibility or other conditions enjoyed by users of associated, adjoining or
nearby uses.
Significant concerns are raised in regard to this outcome due to the service station’s location
adjacent to the Good Shepherd Lutheran College. This issue is discussed in detail in Section 3.4
of this report.
Land Use & Works Provisions
The following codes which regulate land use and design are most applicable to this application:
Business Uses Code
Engineering Works Codes
Landscaping Code
Reconfiguring a Lot Code
The application has been assessed against each of the above applicable codes. The primary
issues arising out of the assessment against the codes are discussed below:
Code Discussion
Business Uses The development can broadly meet the provisions of the code, subject to the
Code conditions ensuring compliance with a range of outcomes including, layout,
pathway connections, waste, landscaping and access. It does, however, raise
significant concerns with health and safety discussed in Section 3.4 of this report.
Driveways & The development provides 10 car spaces, 2 motorbike spaces and a loading zone
Parking Code in addition to the bowser fill-up positions, which is considered sufficient to cater for
the parking demand for the use and meets the outcomes of the Code. Vehicle
manoeuvring areas are sufficient for all vehicles that will access the site, including
tankers. The long entry driveway provides an on-site queuing length of around
50m and will avoid off-site impacts from queuing.
Reconfiguring The development meets the provisions of the Code, with both proposed lots
a Lot Code exceeding the minimum 1,000m2 lot size required for Noosaville’s Industry zone.
The common driveway location avoids multiple accesses in proximity to the
Eumundi Noosa Road/Walter Hay Drive roundabout. Conditions can be applied
to address frontage works, access provisions, and the like.
Landscaping The proposal meets minimum landscaped area and setback requirements under
Code the Code, with the service station site providing double the required 15%
landscaped area at 30% of proposed that lot. Some removal of existing trees on
the site will be required but there is opportunity to retain approximately 10 within
the site frontage. An extract of the submitted preliminary landscaping code is
shown in Figure 6 below.
