RE; PERMISSABLE CHANGE TO DEVELOPMENT APPROVAL - MCU16/0098 &
OPW16/0183, 21 Venture Drive, NOOSAVILLE
Att: Wilhelm Koschade, Assessment Manager
Pursuant with Part 8, division 2 of the Sustainable Planning Act 2009 (The Act hereafter),
our clients wish to apply for a change to their application. This change is defined as a
permissible change, and is after the appeal period of the decision received 17 November
2016.
We believe the requested change constitutes a permissible change as described Section
367, 1 (a)-(d)).
367 What is a permissible change for a development approval.
(1) A permissible change, for a development approval, is a change to the approval that
would not, because of the change -
(a) Result in a substantially different development;
The proposed development maintains exactly the same gross floor area for each
component of the approved business uses, as originally approved (MCU16/0098 &
OPW16/0183).
The proposed development is for Noosa Chocolate Factory as was originally
approved.
The site layout and building footprint of the proposed development is identical to that
which was originally approved.
The proposed trading and operational hours have not changed.
The building design is substantially different, to that which was previously approved.
Our clients have re-branded Noosa Chocolate Factory’s image since the application
was approved, and now they have turned their attention to the image that this
building portrays. Their intention is to construct a memorable, contemporary
minimalist design.
