5.0 STATE GOVERNMENT INTERESTS
5.1 GENERAL
Schedule 10 of the Planning Regulation 2017 sets out matters that comprise assessable
development in addition to those nominate under a local planning instrument, some of which
require referral to SARA for assessment against the nominated benchmarks.
5.2 REMNANT VEGETATION
The proposed development site is mapped as comprising remnant vegetation under the
vegetation management supporting mapping. Clearing of native vegetation for freehold land is
exempt clearing works where it is for residential clearing as per Schedule 21, Part 2, Section 2(b)
of the Planning Regulation 2017. As the material change of use proposal is limited to a dwelling
house, this exemption will apply.
5.3 CORE KOALA HABITAT
The site is also mapped as core koala habitat. Clearing of koala habitat outside of a koala priority
area is not assessable when the works comprise exempted development as defined under
Schedule 24 of the Planning Regulation 2017. The clearing works required for the proposed
dwelling conform to the definition of exempted development as set out in Section 3.3 of this
report, with clearing for the structures requiring being less than 500m2 plus the additional areas
for bushfire management as per the essential management definition. Therefore referral to the
State is not required for clearing of remnant vegetation or koala habitat.
5.4 CONSERVATION SIGNIFICANT PLANT SPECIES
Four conservation significant flora species have been identified on the property during the site
investigation. These include Rhodamnia rubescens, Rhodomyrtus psidioides, Gossia hillii and
Symplocos harroldii. A protected plants flora survey report prepared in accordance with the State
guidelines and an impact management plan have been submitted to the Department of
Environment, Tourism, Science and Innovation to satisfy the State legislative requirements. The
works will be progressed in accordance with an approved protected plants clearing permit which
is separate to Council’s land use approval but is the primary head of power for addressing
conservation significant plant species.
The western waterway intersecting the property is mapped as an amber (moderate risk)
waterway on Queensland waterways for waterway barrier works mapping indicating that any
potential crossings or works within the waterway may impact on fish passage. This waterway is
situated >100m from the development site and will not be impacted.
The bushfire hazard risk for vegetated areas in proximity to the development site nominated
under the State Planning Policy is shown as very high or medium potential bushfire intensity. A
