PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 OCTOBER 2016
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the urban footprint area of the SEQ Regional Plan. The proposal is
consistent with the regional policies of the SEQ Regional Plan and the associated regulatory
provisions.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Noosaville Locality and is zoned Attached Housing. The
proposed use is undefined and therefore required to follow an impact assessable application
process.
Locality Provisions
The commercial use(s) proposed are inconsistent with the site’s residential zoning but generally
seek to adapt and modify the existing commercial approval for the retail garden centre and café.
The site has proximity to Noosaville’s business centre and frontage to Gibson Road, a major
arterial road. The existing approval sought to allow a moderate amount of commercial intensity to
take advantage of the site’s location, while maintaining the residential amenity for adjacent
residents.
The current proposal does not significantly alter the nature of the development and is
supportable, provided impacts on residents continue to be limited. The primary source of
impacts relate to overall parking demand and the scale and hours of operation of the café use.
These aspects are discussed further in the primary assessment issues below.
The applicant originally sought to have full flexibility for all “sub-uses” across all spaces in the site
but this would potentially have allowed the site to operate entirely as a retail shop or restaurant,
which would significantly increase the intensity of the use. The submitted table of uses was
prepared to better define the uses and spaces in which they are to occur. The table reads:
