2. Proposed Amendment of Conditions 9, 10 and 11

It is recommended that existing Conditions 9, 10 and 11, which require the use of sound limiting
devices, be removed.

As outlined in Section 4.2.1 of this report, the current conditions are incompatible with the noise
limits endorsed by the Office of Liquor and Gaming Regulation (OLGR). The discussion also
demonstrates that the venue can comply with the Liquor Regulation without the use of sound
limiting devices.

A replacement condition is proposed that supports the use of the licensed premises’ Risk
Assessed Management Plan (RAMP) as the primary tool for managing noise impacts:

    9. The premises must comply with Section 5.2 and Section 11 of the Risk Assessed
         Management Plan (RAMP), dated November 2024, in relation to procedures for managing
         noise and mitigating impacts on the amenity of the surrounding community.



If recommendations (1) and (2) above are implemented in full, and venue management complies
with the resulting conditions, the venue is not expected to generate unreasonable noise as defined
under the Liquor Regulation 2002.

This revised approach removes the requirement for a sound limiting device but retains noise limits
which:

    •    Considers the current acoustic situation at the premises, including alterations made to the
         premises in 2024.
    •    Considers cumulative noise emanating from the premises.
    •    Are set at clearly identifiable locations representative of the nearest sensitive receptors.
    •    Are consistent with the current OLGR-endorsed noise limits.

This ensures the original intent and amenity outcomes of Conditions 8(iii) and 8(iv) and Conditions
9 to 11 are maintained, while providing a more practical and enforceable noise management
framework consistent with current OLGR-endorsed noise limits.
