RECOMMENDATION
That Council note the report by the Director Corporate Services to the Planning & Organisation
Committee Meeting dated 14 October 2014 and adopt the revised waste management fees and
charges to apply for the remainder of the 2014/15 financial year from 1 November 2014 as set
out in the report by the Director Corporate Services to the Planning & Organisation Committee
Meeting.
REPORT
Council’s waste management activity recovers fees and charges on a commercial basis given it
is a nominated significant business activity.
Councils have a general power to levy commercial charges for the provision of particular
services. This power flows from the general powers of local governments under section 9(1) of
the Local Government Act 2009 (the Act) and the specific recognition in section 262(3)(c) of the
Act of the power to charge for a service or facility, other than a service or facility for which a cost-
recovery fee may be fixed.
A number of waste management fee and charges need amendment due to the recent abolition of
the carbon tax by the federal government. The relevant fees are contained in the table on the
following page including the current fee and the proposed fee for the remainder of the financial
year. The fees in question relate specifically to waste disposed to landfill.
A further fee also needs amendment to reflect the cost of service provision. Council’s holding
tank liquid waste contractor currently charges 1.25 cents (one and a quarter cents) per litre for
literage in excess of 5,000 litres per pump out for domestic holding tanks. The current fee
contained in the fees and charges schedule was set at 1 cent per litre, as the new contract for
liquid waste pump out services was not finalised prior to adoption of the 2014/15 budget. The full
description of the fee and proposed change is also contained in the table below.
Given the logistics associated with the waste management business changing signage and
systems to accommodate the fee changes a commencement date of 1 November 2014 for the
commencement of the fee changes is proposed.
