The garage has a height ranging from 3.08 metres to 4.6 metres, a mean height of 4.49 metres
and a length of 7.8 metres. The bin storage area ranges in height from 1.45 metres to 1.9 metres
and extends out from the rear of the garage for a length of 2.85 metres, due to its height above the
ground level it is anticipated that additional built form will also be required for safety and privacy.
The total length of built to boundary structures along the southern boundary is 10.43 metres and
as such does not comply with the requirements of the Queensland Development Code.
It is considered that the built to boundary garage and bin storage structures will have significant
impacts on the amenity and privacy of the neighbouring property to the south and does not provide
adequate distance from adjoining land uses. The proposed built to boundary garage and bin
storage areas are not supported.
Rear Setback
Acceptable Outcome AO9.3 of the Low Density Residential Zone Code requires a minimum rear
setback for lots less than 550m2 of 1.5 metres up to 4.5 metres in height, 2 metres between 4.5
metres and 7.5 metres in height, and 2.5 metres if above 7.5 metres in height. The dwelling house
is proposed to be setback 4 metres from the rear boundary and as such complies with AO9.3.
While the proposal complies with rear setback requirements of the Low Density Residential Zone
Code, it does not comply with Performance Outcome PO3 of the Coastal Protection and Scenic
Amenity Overlay Code which states:
Where a coastal building line exists on a lot, all buildings, structures and retaining walls do
not extend seaward of the coastal building line for the site, other than —
1. uncovered and unenclosed cantilevered balconies that do not extend greater than 3
metres seaward of the coastal building line; and
2. are setback a minimum of 6 metres from the seaward boundary
The Purpose and Overall Outcomes of the Coastal Protection and Scenic Amenity Overlay Code
relate to the maintenance of coastal processes, the natural landform and the visual character and
scenic amenity of the area.
The proposed development will extend 10 metres seaward of the coastal building line and includes
a cantilevered balcony setback 4 metres from the rear boundary. The existing dwelling house
currently extends 11.5 metres seaward of the coastal building line and as such the proposed
dwelling house will improve the existing rear setback beyond the coastal building line.
