                            Figure 16: Vegetation noted for possible removal

Council’s Senior Environment Officer has reviewed the Ecological Assessment Report and noted
that portions of the site have previously been cleared via bushfire exemptions. It is also noted that
all of the vegetation expected to be impacted by the proposal (refer to Figure 15) can be cleared
under numerous Noosa Council and State Government exemptions for bushfire protection
measures, including Schedule 6 of the Planning Regulation 2017.
A condition is included in the recommendation requiring cleared vegetation to be offset within the
development site. The offset is required to be undertaken within the area of vegetation adjacent to
Cooyar Street to assist in buffering the development from surrounding uses. Conditions have also
been included in the recommendation to ensure a suitably qualified and experienced fauna
spotter/catcher is on site during all vegetation clearing activities. It is therefore considered that,
subject to the inclusion of appropriate conditions, the proposal complies with the relevant
provisions of the Biodiversity, Waterways and Wetlands Overlay Code.
Community Facilities Zone Code
The subject site is zoned Community Facilities and the use, being an extension to an existing
Residential Care Facility, is consistent within the Community Facilities zone, noting that the site is
specifically annotated for this use under Noosa Plan 2020. The proposal predominately complies
with the relevant provisions of the Community Facilities Zone Code, including the proposed use
and built form (setbacks etc) with the only non-compliance being height and gross floor area.
Acceptable Outcome AO17.1 of the Community Facilities Zone Code requires that buildings and
other structures are no more than 8 metres in building height (refer to Figure 17). The proposal
