RECOMMENDATION
That Council note the report by the Property Manager to the Services & Organisation Committee
Meeting dated 12 March 2019 and approve the proposed transfer of the Noosaville Slipway Sub-
lease over Lot 168 SP 177646 and Lot 167 SP 223758 to Craig McGovern trading as Pelican
Noosa Pty Ltd subject to Minister’s consent for the transfer as required under section 322 of the
Land Act 1994.
REPORT
Noosa Council entered into a 20 year lease agreement for 4 Mill Street, Noosaville (Lot 168
SP177646 and Lot 167 SP223758, formerly Lot 167 SP173769) with the Department of Natural
Resources, Mines and Energy (DNRME) on 1 May 2005. Council received consent to sub-lease
part of the land for commercial slipway purposes and the sub-lease commenced on 7 September
2007 and will expire 6 September 2022.
The current sub-lessee of the Noosaville Slipway has a contract of sale for the business. The
sale is conditional on the sub-lease being transferred to the proposed new business owner.
Accordingly, the purpose of this report is to seek Council approval to transfer the Noosaville
Slipway sub-lease to the proposed new business owners being Craig McGovern trading as
Pelican Noosa Pty Ltd.
The proposed new business owner has provided Council with documentation to support the sub-
lease transfer request including references, a business plan and financial information to allow an
evaluation of their suitability to enter into the sub-lease over the slipway. The documentation has
been assessed and the proposed new business owner is deemed suitable to hold the sub-lease.
A deed of assignment is to be executed by the current sub-lessee, the proposed new business
owner and Council. Subsequent to formal Council resolution to approve the sub-lease transfer,
Ministerial consent will also be required prior to registration of the transfer in accordance with
section 322 (1) (a) and (b) of the Land Act 1994.
