SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 MARCH 2019

Previous Council Consideration
Ordinary Meeting Minutes, 19 May 2016, Item 4, Page 6
That Council note the report by the Property and Facilities Manager to the Services &
Organisation Committee Meeting dated 10 May 2016, and approve the proposed transfer of the
Noosaville Slipway sub-lease over Lot 168 SP177646 and Lot 167 SP223758 to Charles Glen
Nichols & Jason Schellaars trading as Noosa River Slipway (QLD) Pty Ltd subject to Ministers
consent for the transfer as required under section 322 of the Land Act 1994.

Finance
There are no financial impacts to Council arising from the proposed sub-lease transfer to the
proposed new business owner.

Risks & Opportunities
Risks

The current sub-lease agreement between Council and the slipway operator expires 6
September 2022 and the head lease between Council and DNRME expires in April 2025. Given
the sub-lease agreement expires before the head lease agreement Council will need to discuss
DNRME’s future plans for the site and proposed future head lease arrangements prior to any
Council sub-lease considerations or negotiations regarding the slipway operation. At this stage,
Council can give no undertakings regarding the future of the site (as Council does not own the
site) or lease terms and this was discussed and acknowledged by the proposed new business
owner on 26/2/2019.

Opportunities

The expiring head lease and sub-lease agreements may provide the opportunity for Council to
negotiate the terms of the future head lease between Council and DNRME and the future sub-
lease to provide a more favourable outcome for ratepayers.

The sub-lease notes Council’s consent to the assignment should not be reasonably withheld if a
suitable sub-lessee emerges and it is on that basis the transfer to the proposed new business
owner is recommended to proceed.
