PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 07 FEBRUARY 2023
Condition 14 – Electrical Reticulation
14. There must be no electrical reticulation system carrying electricity in excess of 24 volts
beyond the revetment wall unless all switches and power outlets are positioned above the
1%AEP flood level.
Applicant’s Representation
The condition relates to electrical reticulation being provided above the 1% AEP flood level where
positioned past the revetment wall. This condition is generally applied to residential pontoons and
jetties and seems to have been included as a general condition and hasn’t considered the
commercial use (office, which is powered) and fuel bowser at the end of the structure. On this basis
we request that the condition be deleted.
Assessment of Representation
It is agreed that this condition is regularly applied to residential pontoons, however it has also been
previously applied to commercial jettys and pontoons. It addresses Council’s duty of care in terms
of public safety, is not onerous and still supports the operation of the fuel bowser. While the
condition may mean the electrical reticulation system for the office and fuel bowser are required to
be modified and/or upgraded this is considered reasonable given the extent of works proposed to
be undertaken to the jetty.
Condition 22 – Audit of Fuel Facility
22. To ensure the safety of persons accessing the approved works and to prevent environmental
harm, a safety audit of the on-site fuel storage tanks, bowsers and associate pipework,
valves, vents and systems shall be conducted by a suitably qualified professional and
submitted to Council for approval prior to the use of the new works (pontoon/jetty extensions).
The audit shall demonstrate that the fuel systems are in a safe and serviceable condition or,
where necessary, identify repair and rectification requirements to meet the relevant
Australian Standards and industry best practice environmental management. Any repair
works must be completed, with certification submitted by the auditor to Council, prior to the
use of the new works (pontoon/jetty extensions).
Applicant’s Representation
The proposed development does not include any modification to the existing onsite fuel storage
tanks, bowsers and associated pipework, valves, vents or systems and they will continue to
operate as they currently do. In addition, the applicant has routine safety audits undertaken for the
current fuel facility and the most recent was completed on 14 December 2021 (refer attached
certificate). With no modifications to the fuel system proposed and a current certificate in place,
there is no requirement for an additional audit as requested by Council and we therefore request
that this condition is also deleted.
Assessment of Representation
It is acknowledged that the plans indicate the existing fuel bowser is to remain in place including
the associated fuel lines etc. being located on the existing jetty structure.
