7     LEGISLATION AND OVERLAYS

7.1      Noosa Plan 2020
The proposed development is considered assessable development and therefore is
assessable against Table 8.2.3.3 Bushfire Hazard Area of Council’s Bushfire Overlay Code
which has been reproduced as Table 4.
Note – Under Chapter 2, Part 1, Section 8, Item 4(a) of the Planning Act 2016, where there is
an inconsistency between a State planning policy and local government planning instrument,
a State planning policy applies instead of a regional plan or local planning instrument.
Therefore, the State Planning Policy – Natural Hazards, Risk and Resilience assessment
benchmarks prevail over those matters prescribed in the NSC Bushfire Hazard Overlay Code
where they involve the same design elements (i.e., the SPP separation requirements prevail
over NSC requirements etc).
