PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 SEPTEMBER 2019

Change to conditions
An assessment of the applicants request to change condition 1 and 2 is further detailed below.
Condition 1
Vessels associated with the marine use of the facility must only be moored within the approved
lease area.
Applicant’s Request
The applicant requests modification of Condition 1 to reference berthing instead of mooring as
detailed above.
Assessment of Request
The applicant’s request is not supported as the terms of lease, planning scheme requirements
and Concurrence Agency Response refer to mooring and not berthing. The terminology should
therefore be consistent and refer to mooring.
Condition 2
Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
otherwise amended by these conditions.

Plan No. Rev. Plan/Document Name Date
26236-J1 D Jetty Plan and Details prepared by SCG Consulting Engineers 12 October 2017
26236-S2 C Jetty Plan and Details prepared by SCG Consulting Engineers 12 October 2017
Applicant’s Request
The applicant seeks to amend the approved plans to detail no setback to the northern lease
boundary as detailed above.
Assessment of Request
As previously detailed the applicants request is not supported as all mooring temporary or long
term should be provided for within the lease area to minimise further cluttering of the Noosa
River. As demonstrated by the aerial photograph below, the jetty is an area that already contains
a number of commercial jetties in close proximity to each other that currently have all boats and
services located within their respective lease areas.
