6. CONCLUSION & REASONS FOR DECISION
The applicant seeks approval for 16 x 2 bedroom Ancillary Dwelling Units within an approved
industrial development located on a site at northern end of Gateway Drive, Noosaville. The
proposed dwelling units are proposed to be located inside the approved building and do not
propose any alterations to the external built form.
Ancillary Dwelling Units are detailed as being code assessable uses in the Industrial zone in
which the site is located. Whilst it is recognised that there may be the need for one caretakers
residence to be provided on site for security reasons, there appears to be no demonstrable need
for a further 15 x 2 bedroom caretakers or employees residences to be provided on the site.
The applicant has not provided sufficient information that demonstrates the proposed 16 x 2
bedroom units will be used in accordance with the Planning Scheme definition which details the
units are to be occupied by the owner of the non-residential use or somebody employed in the
non-residential use. The size of the dwelling units is also not considered to be in accordance with
the planning scheme definition which details that the units are to be subordinate to the non-
residential use. In this instance the two bedroom units have an area that is over 50% of the
industrial floor area. The proposed units are better defined by the Noosa Plan as multiple
dwelling units which are an inconsistent use in the Industry zone and required to be publicly
notified.
The 16 x 2 bedroom units do not meet the Overall Outcomes of the Detached House Code as the
industrial land is not suited to the residential density proposed by the application. The potential
for 32 people to reside on the site and within the industrial estate erodes the ability of the
industrial area to function and attract industrial uses. Significant concerns are also raised as to
the potential impacts associated with reverse amenity especially as the industrial development
has not commenced, it is not clear as the nature of the industrial uses that may be undertaken on
the site and new residential owners may not anticipate noisy industrial uses.
The proposal is further inconsistent with the existing development approval for industrial uses for
the site and represents a piecemeal development.
The application is therefore recommended for refusal.
