GENERAL COMMITTEE MEETING AGENDA 14 FEBRUARY 2022
uses. The applicant is also willing to accept a condition limiting the number of patrons to the gym
to a maximum of 10 persons. Some overflow car parking does further exist in Earl Street (26 new
parking spaces) in reasonable proximity to the site.
The application was referred to Council’s external traffic consultant who advised “…there is
nothing in the existing approval that ties use of the existing conference facility to the
accommodation use, so while it would have been expected that significant conferences at the
existing facility would have had users who also then conveniently stay at the accommodation
overnight, there could be existing conferences where none of the participants use the on-site
accommodation.
I think it would be unreasonable to refuse the proposal on car parking grounds on the basis that
the proposed uses wouldn’t generate an aggregate parking demand in excess to what is
currently permitted.”

Public Notification
The application was publicly notified for fifteen (15) business days in accordance with the Planning
Act 2016. No submissions were received. The following table provides a summary and assessment
of the issues raised by submitters.
CONCLUSION & REASONS FOR DECISION
The proposed development is consistent with the purpose of the Tourist Accommodation Zone to
provide for short-term accommodation and uses to support this accommodation and tourist
attractions apart from the proposed offices. The museum, gym and restaurant will all complement
and enhance the area’s tourism focus and support the site’s visitor accommodation. The proposed
offices, while small in total floor area, do not support this tourism focus and are not consistent with
the purpose of the zone with the code specifically identifying that professional offices are not
established in the Tourist accommodation zone. Further no need has been demonstrated for
additional land to be allocated for office space and the proposed offices, and the proposal has the
potential to undermine the business centre strategies.
It is therefore recommended that the application is approved in part to enable the Community Use
(Surf Museum), Food and Drink Outlet (Restaurant) and Indoor Sport and Recreation (Gym) uses
to occur, with the offices refused.
