4.0 Proposed Development
4.1 Overview
This application seeks approval a Development Permit for Reconfiguration of a Lot by Subdivision (1 Lot into 2 Lots) on land
described as Lot 1 on SP177941, situated at 149 Black Mountain Range Road, Black Mountain QLD 4563.
The Plan of Development prepared by Danya Cook Town Planning included at Appendix B, demonstrates the proposed lot layout.
4.2 Proposed Lots
Minimum Lot Size - Table 9.5.1.4
The subject site features an area of 50010m2 (5.001ha). Upon completion of the proposed subdivision, the following areas and
road frontages will apply for each newly created lot:
Proposed Lot Number Proposed Area Proposed Road Frontage
Lot 6 38420m2 (3.842ha) 137.555m
Lot 7 11590m2 (1.159ha) 19.83m
(Easement - Access and Services)
In accordance with Table 9.5.1.4 - Minimum Lot Size of the Reconfiguration of a Lot Code of the Noosa Plan 2020, it is acknowledged
that the minimum lot size applicable to subdivision within the Rural Residential Zone is 1.5ha. As demonstrated by the Plan of
Development included at Appendix B, proposed Lot 7 comprises an area of 1.159ha, which is non-compliant with Table 9.5.1.4 -
Minimum Lot Size - please refer to Section 5.2 - Level of Assessment and Assessment Benchmarks (Codes), below.
The intent of the proposed reconfiguration seeks to maintain the amenity and privacy between the proposed Lot 6 and Lot 7. The
applicant / owner intends to retain proposed Lot 6 as his principal place of residence and on-sell proposed Lot 7. The proposed
common boundary maintains the rural residential nature of the property and follows an established tree line, which provides for a
natural buffer and separation between the proposed lots. Despite non-compliance with the minimum lot size, the proposed lot
configuration represents the most logical subdivision layout when consideration is afforded to delivering an optimal rural
residential character whilst appropriately responding to the natural attributes of the land, as discussed below.
Biodiversity and Riparian Buffer Area
The configuration of proposed Lot 7 has been strategically crafted with consideration of avoiding mapped Area of Biodiversity
Significance and Riparian Buffer Area, as well as maintaining an adequate level of amenity and privacy between the proposed lots.
As demonstrated by the Plan of Plan of Development included at Appendix B, compliance with Acceptable Outcome AO6.1 of the
Biodiversity, Waterways and Wetlands Overlay Code of the Noosa Plan 2020 is achieved, as the proposed development and clearing
of vegetation does not occur within a Riparian Buffer Area considering the mapped areas are wholly contained within proposed Lot
6.
In support of the proposed development, please refer to the Technical Memorandum - Assessment of Ecological Matters prepared
by Equilibrium Ecology included at Appendix C, which summaries the design measures taken to avoid the mapped overlays, and
therefore, provides justification for non-compliance with the minimum lot size.
Bushfire Hazard
In consideration of the mapped bushfire hazard impacting the site, Equilibrium Ecology has also prepared a Bushfire Hazard
Assessment included at Appendix D, which concludes that the site is contained within a Low Hazard Area.
9
Planning Report 2025-15 July 2025
Page 11
DANYA COOK TOWN PLANNING
Landslide Hazard
In consideration of the mapped landslide hazard impacting the site, Tectonic Geotechnical Pty Ltd has prepared a Geo-
Environmental Investigation included at Appendix E, which confirms that proposed Lot 7 can accommodate a suitable building area
inclusive of land application area that comprises a Low Risk of slope instability provided:
• The proposed building envelope at Lot 7 is sited within the acceptable building area, as shown on Figure 1 of the report.
• From a stability perspective, footings supporting the future residence and associated ancillary structures must be founded
as recommended in Section 6.3 of the report, at a minimum.
• Unless assessed and approved by a geotechnical RPEQ, filling must be limited to:
o No more than 1m height on slopes 10°.
o No more than 0.5m height on slopes >10°.
• All retaining walls exceeding 1m high and / or subject to surcharge loads must be engineer designed and certified, which
must include an assessment of global and internal stability by the designer.
4.3 Access
As demonstrated by the Plan of Development included at Appendix B, access will be maintained via the established driveway
crossover located at the southern corner of proposed Lot 6. A new easement (access and services) is proposed over Easement B
and Easement D on SP177941 to service proposed Lot 7, which makes good use of existing infrastructure to deliver a consolidated
lawful and safe access arrangement to Black Mountain Range Road.
4.4 Provision of Services and Stormwater
As mentioned above under Section 3.1.6 - Access and Services, the existing dwelling contained at proposed Lot 6, is serviced by an
on-site potable water supply and on-site wastewater treatment system, reticulated overhead supply of electricity and reticulated
supply of telecommunications. The current service connections available to proposed Lot 6 will be altered and modified where
required, to be fully contained within the lot in which they serve.
Following approval of the subdivision development, proposed Lot 7 will be provided with connection to infrastructure services,
both reticulated and on-site. In this regard, please refer to the Geo-Environmental Investigation included at Appendix E. The Geo-
Environmental Investigation recommends that wastewater for proposed Lot 7 should be directed to a suitably sized Household
Sewerage Treatment Plant (HSTP) connected to a shallow subsurface irrigation system. Due to the spatial limitations posed by the
natural drainage line and dam to the north of the lot, Tectonic Geotechnical Pty Ltd recommend the HSTP be licensed to produce
Advanced Secondary standard effluent.
Furthermore, with respect to stormwater, the Geo-Environmental Investigation suggests that adequate site drainage be installed
to ensure that stormwater is directed away from the building site at proposed Lot 7, to include retaining walls and batters. For
further details with respect to drainage recommendations, please refer to Appendix E.

6.0 State Planning
The Planning Regulation 2017 prescribes assessment benchmarks that an application must be assessed against, which are
additional or alternative to the benchmarks contained within local planning instruments.
The assessment benchmarks are contained within:
• The Regional Plan and Part E of the State Planning Policy 2017, to the extent that they are not appropriately integrated
into the Planning Scheme; and
• Schedule 10 of the Planning Regulation 2017.
The Regional Plan, Part E of the State Planning Policy 2017, and Schedule 10 of the Planning Regulation 2017 are addressed below.
6.1 Regional Plan
ShapingSEQ 2023 is the principal planning document for managing growth and development within the South East Queensland
region. The subject site is included within the Rural Living Area, which identifies areas for rural residential development in locations
that provide housing and lifestyle choice while limiting the impact of inefficient use of land.
In accordance with Part 2 - State Planning Provisions, Section 2.2 - Regional Plan of the Noosa Plan 2020, it is stipulated that the
Minister has identified that the Planning Scheme, appropriately advances the South East Queensland Regional Plan 2017, as it
applies in the Planning Scheme area. However, since the commencement of the Planning Scheme, ShapingSEQ 2023 version of the
Regional Plan has taken effect, although it is considered that ShapingSEQ 2023 does not significantly affect the Regional Plan
interests reflected in the Noosa Plan 2020. Accordingly, an assessment against the Regional Plan is not necessary.
6.2 State Planning Policy 2017
A review of the State Planning Policy Mapping identifies the following state interests relevant to the land:
State Planning Policy Mapping
Agriculture
• Agricultural Land Classification - Class A and B.
• Important Agricultural Areas.
Biodiversity
• MSES - Regulated Vegetation (Intersecting a Watercourse).
• MSES - Wildlife Habitat (Endangered or Vulnerable).
• MSES - Wildlife Habitat (Koala Habitat Areas - Core).
• MSES - Regulated Vegetation (Category R).
• MSES - Regulated Vegetation (Essential Habitat).
Water Quality
• Water Resource Catchments.
Natural Hazards Risk and Resilience
• Flood Hazard Area: - Local Government Flood Mapping Area.
• Bushfire Prone Area: - High and Medium Potential Bushfire Intensity, and Potential Impact Buffer.
The State Planning Policy 2017 defines the Queensland Government’s policies about matters of state interest in land use planning
and development. The State Planning Policy only applies to development assessment if the Planning Scheme has not yet
appropriately integrated the State Planning Policy. If there is a discrepancy between the Local Planning Scheme and a State Planning
Policy, then the State Planning Policy overrides the Planning Scheme.
14
Planning Report 2025-15 July 2025
Page 16
DANYA COOK TOWN PLANNING
In accordance with Part 2 - State Planning Provisions, Section 2.1 - State Planning Policy of the Noosa Plan 2020, the State Planning
Policy is identified as being reflected in the Planning Scheme, except for the Natural Hazards, Risk and Resilience - Coastal Hazards,
which is reflected in part.
Where state interests are not integrated into the Planning Scheme, the applicable assessment benchmarks, relevant guiding
principles, state interest statements, and state interest policies contained in the State Planning Policy applies to development.
In accordance with Section 8(4)(a) of the Planning Act 2016, the State Planning Policy applies to the extent of any inconsistency.
Following a review of the State Planning Policy 2017 and the Noosa Plan 2020, it is determined that the proposed development
does not conflict with the intent of the State Planning Policy 2017, and as such, an assessment against the State Planning Policy is
not necessary.
6.3 Planning Regulation 2017
A review of the Development Assessment Mapping identifies the following state interests relevant to the land:
Development Assessment Mapping
• Fish Habitat Areas: - Queensland Waterways for Waterway Barrier Works (Low Order Waterway).
• Water Resources: - Water Resource Planning Area Boundaries.
• Native Vegetation Clearing: - Category B Area that is a Least Concern Regional Ecosystem.
• Koala Habitat in South East Queensland Region: - Koala Habitat Area (Core Koala Habitat).
Following a review of the State Assessment and Referral Agency (SARA) Development Assessment Mapping and Schedule 10 of the
Planning Regulation 2017, it is determined that this application does not require referral to SARA for matters relating to Native
Vegetation Clearing or Koala Habitat, as the proposed development avoids clearing and impacts on native vegetation, by way of
mapped native vegetation being wholly contained within proposed Lot 6 and the location of the proposed new boundary not
resulting in “as of right” opportunity to clear native vegetation, and the development not interfering with koala habitat.
