GENERAL COMMITTEE MEETING AGENDA 16 JULY 2018
The definition of minor change no longer includes a provision around whether a person is likely to
make a submission to the proposed change as previously provided for under the Sustainable
Planning Act 2009.
The proposed change to the development approval requested by the applicant meets the
Planning Act 2016 requirements for a minor change as detailed in the report to the Planning &
Environment Committee meeting. The proposed change will not result in a substantially different
development to the approved development.
While an increase in the number of gaming machines may arguably increase the severity of
known social impacts, the proposal does not materially change the intensity of the approved use
given the current Noosa Plan does not regulate gaming machines. The proposed change raises
no conflict with the Noosa Plan and therefore there are no appropriate grounds to refuse the
requested change and require the applicant to lodge a new development application in order to
publicly notify the requested change on these grounds. Council could only reasonably regulate
gaming machines through the development assessment process if there were specific planning
scheme provisions for gaming machines and there is currently nothing to this effect in The Noosa
Plan.
5. Can Council consider the issue of need in the community services zone and if so
what criteria could apply?
The proposed use is specifically contemplated for the site by The Noosa Plan and therefore is
not required to demonstrate need given the uses consistency with the site’s community services
zoning.
CONCLUSION
It is concluded that while it is concerning that the RSL is continuing to increase the number of
gaming machines within the club, the proposed increase is consistent with their current state
licence. The proposed increase is a moderate increase of 15 machines representing an 8.1%
increase and does not raise any conflict with The Noosa Plan. Therefore, officers confirm their
previous recommendation to Council to change the condition to reflect the number of gaming
machines currently approved by the state and investigate the potential for Council to develop a
policy and/or introduce planning scheme provisions in the future.
