Good afternoon Duncan,

Application for Easement Encroachment
New Construction of Driveway (“Proposed Obstruction”)
Easement A on RP904040 – Sewer (“Easement”)
Lot 0 on BUP105742 – 3 Gibson Road Noosaville

Thank you for your application.

An Easement in Gross Dealing 701574232 for the purpose of sewer is registered on the subject land, with the former
Council of the Shire of Noosa being the registered interest holder.

Pursuant to the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009, Northern SEQ
Distributor-Retailer Authority (Unitywater) as a distributor-retailer may exercise the same rights as the local
government for the purpose for which the easement was created.

Unitywater has reviewed your application and advise Unitywater does not object to the Proposed Obstruction
within Unitywater’s Easement based on the attached plans.

However, Unitywater reserves its Easement rights and in the event Unitywater needs to conduct works within the
Easement. In the event the Proposed Obstruction prevents Unitywater from accessing its assets within the
Easement, the Proposed Obstruction will need to be removed at the landowner’s cost.

It is your responsibility to ensure that the Proposed Obstruction complies with the Queensland Development Code
Mandatory Part 1.4 (QDC MP 1.4).

In the event that the construction does not comply you will need to make an application to Unitywater’s
Development Services through the Development Portal (https://portal.unitywater.com/) to Build Over or Near Water
Supply or Sewerage Infrastructure. Details can be found on our website via the following link
https://www.unitywater.com/residential/building-and-landscaping/building-over-pipes-and-easements

Should you require any further clarification in relation to this matter please do not hesitate to contact me.

Kind Regards,
Emma
