PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 JANUARY 2014
The following table gives an indication of the extent of the conflict raised by the development’s
component uses with the zonings of the land on which they’re proposed:
Proposed Use Community Services Zone Business Centre Zone
Entertainment and Dining Inconsistent Use N/A
Business
- Type 3 Bar (Tavern)
Retail Business Inconsistent Use Consistent Use
- Type 2 Shop & Salon (Liquor Store & Part Stage 2 (Stage 1 Retail & Part Stage 2
Retail) Retail)
Commercial Business - Type Inconsistent Use Consistent Use
1 Office (Part Stage 2 Commercial) (Stage 1 & Part Stage 2
Commercial)
Education - Type 3 Adult Consistent Use Consistent Use
Multiple Housing Inconsistent Use N/A
- Type 4 Conventional (Units)
The table indicates the proposal involves a mix of consistent and inconsistent uses within the
site’s split business and community zonings.

9.8.2 (t) For the Community Services Zone—land for Community Uses and Infrastructure Uses—

ii) provides for the infrastructure, indoor recreation, education, social and safety
needs of the local community, including people with special needs, such as the
elderly, children, low-income earners and disabled persons; and
iii) includes housing and short term accommodation for people with special needs
such as the elderly and budget travellers;
The development proposal is clearly a major departure from the planning scheme expectations
for the Community Services zone, as the application effectively seeks to have the Bowls Club site
considered as an extension to the Business Centre zone.
The applicant acknowledges the conflict with the zoning and the requirement under section 326
of the Sustainable Planning Act for it to demonstrate sufficient grounds to overcome the conflict
with the planning scheme. To this end, it submits the following grounds in favour of the
development:
