PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 JANUARY 2014
Council Carpark Site
Council’s carpark site was formerly home to the Noosa Tennis Club, prior to the club agreeing to
sell the land to council and relocate to council land at the club’s current site in Girraween Estate.
Council purchased the site in 1995 to construct a public carpark. The costs were met by
development contributions and a local area levy.
A boundary realignment was undertaken with the Bowls Club around the same time (effectively a
land swap), which allowed better utilisation of both sites.
ASSESSMENT
Framework for Assessment
Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of the
following statutory planning instruments to the extent they apply to the development:
State Planning Policies;
the South East Queensland Regional Plan;
State Planning Regulatory Provisions;
the Planning Scheme for the local government area; and
any Temporary Local Planning Instrument in place for the local government area.
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
Statutory Instruments – State and Other
State Planning Policies
The following State Planning Policies are applicable to this application:
State Planning Policy 2/02 Planning and Managing Development Involving Acid Sulfate
Soils;
State Planning Policy 1/03 Mitigating the Adverse Impacts of Flood, Bushfire and Landslide;
These SPPs have been deemed by the Minister for Local Government and Planning as being
appropriately reflected in council’s planning scheme and therefore do not warrant a separate
assessment. In addition, the recently adopted Single State Planning Policy does not apply, as it
came into effect after the application had entered the decision period.
South East Queensland Regional Plan
The site is located within the urban footprint of the South East Queensland Regional Plan. The
proposal is for urban development within the footprint and is consistent with the regional land use
intent, regional policies and desired regional outcomes.
Statutory Instruments – Planning Scheme
The applicable planning scheme for the application is The Noosa Plan (8 August 2011). The
following sections relate to the provisions of the Planning Scheme.
Noosa Heads Locality Code
The site is located in the Noosa Heads locality and is zoned a mix of Community Services and
Business Centre zones. The proposed tavern and liquor store uses are listed as inconsistent
uses within the Community Services zone and the application is, therefore, subject to an impact
assessable application process.
