Community and Development
SUMMARY/PURPOSE
Under “The Local Government (De-amalgamation Implementation) Regulation 2013”, the current
infrastructure charges resolutions and policies adopted by the Sunshine Coast Council transfer
and continue to apply to The Noosa Plan planning scheme area until such time they are reviewed
and replaced by new resolutions and policies adopted by Noosa Council.
This report presents three items for Council’s consideration and direction on current Sunshine
Coast Council resolutions that currently apply to Noosa Council relating to:
1. Adopted infrastructure charges resolution;
2. Application of infrastructure charges relating to missing networks for “Extension to Relevant
Period” to existing development approvals and for charges applicable to subsequent
“Building Approvals”; and
3. Requests to transfer from previously applied infrastructure contributions/charging regimes
to the current adopted infrastructure charges regime.
This report also notifies Council of the State Government’s review currently underway to the
current adopted infrastructure charges regime and priority infrastructure planning requirements.
BACKGROUND INFORMATION
The current Adopted Infrastructure Charges regime commenced on 1 July 2011 and replaced all
previous contributions and charges regimes applying to new development approvals issued from
that date. This new legislation generally reduced development charging levels and because the
charges are no longer connected directly to the provision of infrastructure and associated costs,
has introduced complications in transitioning between the previous and current regimes for new
development applications subsequent to previous approvals and extensions to relevant periods
for existing approvals.
Under the “Sustainable Planning Act 2009” (SPA), infrastructure charges are triggered and
issued on development approvals for Reconfiguration of a Lot, Material Change of Use and
Building Work. These infrastructure charges relate to the provision of “trunk” infrastructure
required to service existing and future development where new development contributes its
proportional fair share of costs in the provision of “trunk” infrastructure needed to enable
development to occur.
